Инкорпорированная [incorporation doctrine] поправка к Конституции США [Constitution, U.S.], ратифицирована 15 декабря 1791. Поправка гласит: "Ни одно лицо не должно привлекаться к ответственности за преступление, караемое смертью, либо за иное позорящее преступление иначе как по представлению или обвинительному заключению большого жюри, за исключением дел, возбуждаемых в сухопутных или морских частях либо в милиции, находящихся на действительной службе во время войны или опасности, угрожающей обществу; равным образом ни одно лицо не должно за одно и то же правонарушение дважды подвергаться угрозе лишения жизни или телесного наказания, не должно принуждаться в каком-либо уголовном деле свидетельствовать против себя, не должно лишаться жизни, свободы либо собственности без надлежащей правовой процедуры; частная собственность не должна изыматься для общественных нужд без справедливого вознаграждения" ["No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life of limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property without due pricess of law; nor shall private property be taken for public use, without just compensation" (infamous crime)]. Является частью Билля о правах [Bill of Rights]. Эти гарантии первоначально предоставлялись обвиняемым только федеральным правительством (что было специально подчеркнуто Верховным судом США [Supreme Court, U.S.] в 1833 в решении по делу "Бэррон против города Балтимора" [Barron v. Они были фактически включены в Четырнадцатую поправку [Fourteenth Amendment], ограничивающую произвол властей штатов через положение о "надлежащей правовой процедуре" [due process of law].
